These Terms of Service ("Terms") govern your use of the SereneHead mobile app and related services provided by Qimo Lab Inc ("SereneHead," "we," "us," or "our").
By using SereneHead, you agree to these Terms. If you do not agree, do not use SereneHead.
1. Eligibility
You must be at least 16 years old, and old enough to consent to the processing of your information under applicable law, to use SereneHead. If you are using SereneHead on behalf of another person or organization, you represent that you have authority to bind them to these Terms.
2. What SereneHead does
SereneHead is a personal wellness and tracking app that lets users log migraine attacks and treatments, record voice notes for structured attack logging, view weather-related context, generate doctor report PDFs, and generate AI-assisted summaries from logged information.
The current launch version also uses account sign-in and private sync so the journal stays consistent across your devices. Some features may be limited, gated, paid, or changed over time.
3. Medical disclaimer
SereneHead is not a medical device, doctor, emergency service, or substitute for professional medical advice, diagnosis, or treatment.
- SereneHead provides organizational and informational tools only.
- AI-generated summaries, transcripts, and extracted fields may be incomplete or incorrect.
- Doctor report PDFs are based on self-reported information and app-generated summaries.
- You should review any output before relying on it or sharing it with a clinician.
If you think you are having a medical emergency, call emergency services or contact a qualified healthcare professional immediately.
4. Your account
The current launch flow requires an account and authenticated session. When you sign in:
- you must provide accurate information as made available by your sign-in provider;
- you are responsible for activity that occurs under your account; and
- you must promptly notify us if you believe your account has been compromised.
We may suspend or terminate access if we reasonably believe your use violates these Terms, creates security risk, or exposes us or others to harm.
5. Your content
As between you and SereneHead, you retain ownership of the information you submit to the app, including entries, notes, transcripts, treatment records, and report profile details ("User Content").
You grant SereneHead a limited, non-exclusive right to host, store, copy, process, transmit, and use your User Content only as necessary to operate the app, authenticate you, privately sync your data, generate requested AI outputs, generate requested reports, maintain and secure the service, and comply with law.
You represent that you have the rights necessary to provide your User Content and that your User Content does not violate law or the rights of others.
6. Acceptable use
You may not:
- use SereneHead in violation of law;
- interfere with or disrupt the service;
- attempt to gain unauthorized access to accounts, systems, or data;
- reverse engineer or misuse non-public parts of the service, except where law prohibits that restriction;
- use the service to develop a competing service through unauthorized access or extraction; or
- upload malicious code or content intended to harm the service or others.
7. AI features
SereneHead may use third-party AI models and backend services to process voice recordings and generate summaries.
By using those features, you understand and agree that:
- your inputs may be sent to third-party infrastructure used to provide the feature;
- AI outputs may contain errors, omissions, or misleading information;
- AI outputs should be reviewed by you before use or sharing; and
- you will not rely on AI output as a substitute for professional medical advice.
8. Privacy
Our collection, use, storage, and sharing of personal information are described in the Privacy Policy. Because SereneHead may process health-related information, you should review the Privacy Policy carefully before using the app.
9. Paid features
SereneHead currently includes optional Pro subscriptions and one-time purchases. Pricing, billing, renewal terms, and restore options are shown in-app at purchase time.
- App Store terms, including Apple's Standard EULA and refund policies, may also apply and may govern the actual transaction;
- paid access may renew or expire according to the purchase terms presented at checkout; and
- we may change, add, or discontinue paid features in the future, subject to applicable law.
10. Intellectual property
SereneHead and its software, design, branding, text, graphics, compilations, and non-user content are owned by us or our licensors and are protected by intellectual property laws.
Subject to these Terms, we grant you a limited, revocable, non-transferable, non-sublicensable license to use SereneHead for your personal, non-commercial use.
11. Availability and changes
We may modify, suspend, or discontinue all or part of SereneHead at any time. We do not guarantee that any feature will always be available, error-free, or continue in its current form.
We may also update these Terms from time to time. For material changes, we will provide reasonable advance notice where required by law through an in-app notice, email if we have your address, or another reasonable method. Your continued use of SereneHead after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may stop using SereneHead and delete your account before the effective date.
12. Termination
You may stop using SereneHead at any time.
We may suspend or terminate your access if:
- you materially breach these Terms;
- we are required to do so by law;
- your use creates legal, security, or operational risk; or
- we discontinue the service.
Sections that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, limitations of liability, disputes, and other general terms.
13. Disclaimers
SereneHead is provided on an "as is" and "as available" basis, to the fullest extent permitted by law. We disclaim all warranties, express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and that the service will be uninterrupted, secure, or error-free.
Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law.
14. Limitation of liability
To the fullest extent permitted by law:
- SereneHead will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, use, or data; and
- SereneHead's total liability arising out of or relating to the service or these Terms will not exceed the greater of: (a) the amount you paid us for the service in the 12 months before the event giving rise to the claim, or (b) USD 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, fraud, death or personal injury caused by negligence, or other liabilities that cannot be excluded under mandatory consumer protection laws.
15. Indemnity
To the fullest extent permitted by law, you will indemnify and hold harmless SereneHead, its affiliates, and their officers, directors, employees, and agents from claims, damages, losses, and expenses arising out of your misuse of the service, your violation of these Terms, or your violation of law or the rights of a third party.
This indemnity does not apply to the extent it is prohibited or limited by mandatory consumer protection laws in your jurisdiction of residence.
16. Apple App Store terms
The following terms apply if you download SereneHead from the Apple App Store. They are in addition to, and where they conflict take precedence over, the rest of these Terms with respect to your use of the app on an Apple device.
These Terms are concluded between you and SereneHead, not Apple Inc. Apple is not responsible for SereneHead or its content. Your license to use the app is limited to a non-transferable license on Apple-branded products you own or control, as permitted by Apple's applicable terms.
SereneHead, not Apple, is responsible for maintenance, support, product claims, and intellectual property claims relating to the app, to the extent required by applicable law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as such.
17. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in San Francisco, California, except where applicable consumer law provides otherwise.
If you are a consumer residing in the EEA, UK, or another jurisdiction with mandatory consumer protections, nothing in these Terms deprives you of rights you are entitled to under the mandatory laws of your country of residence.
